These Terms of Service ("Terms") govern your access to and use of the website at constantstream.inc and the funding application offered by Constant Stream Inc., a Delaware company, operating as Constant Stream ("Constant Stream," "we," "us," or "our"). Please read them carefully.
1. Acceptance of these Terms
By accessing the site, submitting an application, or otherwise using our services, you agree to be bound by these Terms and by our Privacy Policy. If you are using the site on behalf of a business, you represent that you are authorized to bind that business, and "you" refers to both you and that business. If you do not agree, do not use the site.
2. What Constant Stream is
Constant Stream is a business-funding house. We may fund from our own capital and/or act as a broker, routing applications to one or more third-party funders and lenders to source options. We evaluate applications, present funding offers, and help structure terms. We are an intermediary and funder for commercial financing.
We do not guarantee funding. Submitting an application does not guarantee an offer, and presenting an offer does not guarantee funding. Products we may present include revenue-based financing / merchant cash advances, business lines of credit, term loans, and equipment financing, subject to availability and underwriting.
3. Eligibility
Our services are available only to businesses operating in the United States and are offered for commercial purposes only — they are not personal, family, household, or consumer credit. By applying you represent that the funding you seek is for business purposes, and that you are at least 18 years old and authorized to request funding on behalf of the business.
4. Your representations
When you submit an application and supporting documents, you represent and warrant that:
- All information you provide — including business details, stated revenue, and existing positions — is accurate, current, and complete.
- The bank statements and other documents you upload are genuine, unaltered, and relate to the business named in the application.
- You are authorized to submit that information and those documents, and to authorize us to share them with funding partners for the purpose of sourcing offers.
- Your use of the site and submission of the application do not violate any law or any agreement to which you or the business are bound.
You agree to keep your information current and to promptly correct anything that becomes inaccurate.
5. Applications, offers, and no obligation
Any offer we or a funding partner present is subject to underwriting, verification, and final approval, and may be conditioned, modified, or withdrawn. Nothing on this site is itself an offer of credit or funding.
Submitting an application creates no obligation on either party. No funding commitment exists, and neither you nor Constant Stream is bound, until a separate written agreement governing the specific funding is signed by the parties to it. Those funding agreements — not these Terms — govern the funding itself, including all pricing, fees, and repayment obligations.
6. Website provided "as is"
The website and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or secure, or that any information on it is complete or current. Any reliance on site content is at your own risk.
7. Limitation of liability
To the fullest extent permitted by law, Constant Stream and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the site or these Terms, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability relating to the site and these Terms will not exceed the greater of (a) the total fees you paid us in the twelve (12) months preceding the claim or (b) USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
8. Indemnification
You agree to defend, indemnify, and hold harmless Constant Stream and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the site, your application or submitted documents, your breach of these Terms, or your violation of any law or third-party right.
9. Intellectual property
The site and its content — including text, design, layout, logos, the Constant Stream name and mark, and underlying software — are owned by Constant Stream or its licensors and are protected by intellectual-property laws. You may use the site only for its intended purpose of evaluating and applying for business funding. You may not copy, reproduce, modify, distribute, scrape, reverse-engineer, or create derivative works from any part of the site without our prior written consent.
10. Acceptable use
- Do not submit false, fraudulent, or unauthorized information or documents.
- Do not attempt to gain unauthorized access to the site, other users' data, or our systems.
- Do not use the site for any unlawful purpose or in a way that could disable, overburden, or impair it.
11. Governing law & dispute resolution
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The parties agree that any dispute arising out of or relating to these Terms or the site will be resolved exclusively in the state and federal courts located in New Castle County, Delaware, and you consent to that jurisdiction and venue.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the site after changes take effect means you accept the updated Terms. If you do not agree to the changes, stop using the site.
